It has always been our policy at Livid Thorn to maintain a high level of respect towards our customers and though we like to keep things relatively simple, it has become necessary to create a Terms and Conditions to comply with legislation and add to our credibility.

If you require a phone number or address for contact please let us and know and we will be able to provide you with such information. We make it a strict commitment to respond to all emails next working day (Mon-Fri) and feel that our efficiency in responding to enquiries is of a high standard. Customer enquiries is considered of great importance and we endeavour to offer the best service possible with no complications. It is important also to note that we are based in the United Kingdom and are therefore acting upon the laws of this country. We offer service worldwide and ask that all customers accept the policies stated.
Data & Privacy. Livid Thorn is committed to protecting your privacy and maintaining the security of any personal information received from you. We strictly adhere to the requirements of the data protection legislation in the UK. The purpose of this statement is to explain to you what personal information we collect and how we may use it. When you order, we need to know your name, address and email address. This allows us to process and fulfil your order. You have the option to withhold personal information that is not required for the order process. We use your personal information purely for payment and processing of your order purposes. We may use your contact details to keep you up-dated about promotions or offers that we think will be of interest to you. We follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access in accordance with the UK data protection legislation. The only information we collect is your email address and the items which you have ordered. In order to maintain the accuracy of our database, you can check, update or remove your personal details by contacting us by email.
Delivery & Supply. We have a strong commitment to processing orders promptly and we aim to always issue an email order confirmation verifying your order. If paying by Paypal, you will always receive an order confirmation from them, which can be used as your receipt for payment. All of our products advertised on our website are clearly marked when out of stock. This renders all garments available for immediate dispatch except for those labeled “SOLD OUT!” in the drop-down size menu. It is a general rule that all United Kingdom based orders will take approximately 3-4 working days from dispatch to arrive. Orders placed outside of the United Kingdom are estimated to take 5 working days within Europe, and 7 working days for the rest of the world. However please note that these are only estimates and we are not responsible for any delays in the postage of your order once it has been handed to the mail service for delivery. In the unlikely event of your order not arriving on time, please do not hesitate to contact us by email so that we can trace your order for you. Please note that we are not responsible for missing items if you have provided us with an incorrect address, as you the customer are entirely responsible for the address you provide when placing your order. Your order will be dispatched to the address provided by you and we do encourage you to verify your account or check the accuracy of your details, especially if you have recently moved house. We also encourage you to print and retain a copy of your transaction as we do not send receipts with our orders to help the environment. Delivery costs are listed on the products page in the drop-down menu on the page from which you are ordering.
Returns. We highly recommend checking the size guide before placing your order, but if for some reason you wish to cancel or return your order, you must contact us at lividthorn@hotmail.com within 7 days of receiving your order to arrange the return and exchange. We regret that we cannot accept any returns or exchanges that have passed this time. You, the consumer, have the responsibility to pay the postage cost to return the item to us. A postage charge is also required to dispatch your exchange item. In the case of refunds, the delivery charge will NOT be refunded. Therefore the original cost of delivery will be deducted from the refund amount per item. Please note that goods made to customers specification (such as a specific size requests) are exempt from the returns policy. Under the Distance Selling Regulations, the item being returned MUST be in the original condition in which you received it. Therefore you cannot have damaged, or worn the item other than to try it on, washed it, or sprayed it with any deodorants and/or perfume/cologne. If, on return, we do not consider the item to be in its original condition, then we reserve the right to return the item to yourself without continuing with the exchange. Please note that all sale items are exempt from the refund or exchange policy.
Payment. We require payment before the dispatch of any order. This is usually done via PayPal which ensures complete safety and security. You are not required to become a member of PayPal to place and pay for an order, you can pay as a guest with a valid credit or debit card. Alternatively we do accept cash, cheque and postal order payments. When paying with a cheque we adapt the standard process of waiting 7 working days for the cheque to be guaranteed clear. Postal orders are usually accepted immediately and this process is faster than paying by cheque. When sending money this is done at your own risk and for this we recommend recorded delivery to ensure that it does not go missing. If you do wish to pay buy by cheque, cash or postal order, then we ask that you print out and fill an order form. We then ask that you send us an email stating clearly that you wish to use alternative payment and we will then provide you with an address.
Final Note. It is perhaps slightly patronising being forced to create such legislation in order to comply with laws. Mainly because it appears trivial to state what has been mutually understood between Livid Thorn and its customers since we began.
